A quick note before we get into it: the passing today of Mike Ditka. I didn’t know him personally, but anyone connected to the Packers knows what he meant to the Bears, to Chicago, and to the history of this rivalry. RIP.

On to today’s topic — and it’s one I’ve been watching closely.

The NFL is the last major sports league to stay out of prediction markets. Baseball has a deal with Polymarket. The NHL is partnered with prediction market companies. LeBron James and Giannis Antetokounmpo have individual deals with Kalshi. The NFL has said no.

But this week the league filed an amicus brief asking the United States Supreme Court to take up a case involving prediction market regulation. That’s not nothing. The NFL isn’t jumping in — they’re making sure the rules are right before they do.

The core issue: prediction market companies like Kalshi and Polymarket are regulated by the CFTC, a relatively small federal body. Traditional sportsbooks like DraftKings and FanDuel are regulated state by state, with much more oversight. And the NFL is worried about something specific — event contracts. Things like how many penalties will be called in a game. How long the national anthem will last. Things that could be manipulated far too easily.
